Draft for review. This document describes what AxieFlash does today, but it has not had a legal review yet. Text in [brackets] is a detail the owner has not decided yet.

Acceptance of these terms

These terms apply when you use the AxieFlash app. The first time the app opens, it asks you to tick a box agreeing to these terms and acknowledging the Privacy Policy, and a second box confirming your age. You can't continue until you tick both. If these terms or the Privacy Policy change in a way that matters, the app asks you again.

If you don't agree, don't use AxieFlash. Reading this website doesn't sign you up for anything.

The service

AxieFlash is a flashcard study app with game-style play. You make cards from your notes, on your phone or with Cloud AI, and play them in Study, Game Mode and Axie Run. It is operated by axieflash (Pinamlayan, Oriental Mindoro, Philippines).

What you can use depends on your plan (free or Premium), whether you are an approved beta tester, and the release stage. AxieFlash is in a closed beta and may change a lot before it launches.

Eligibility and your account

You must be at least 3 years old to use AxieFlash. If you are under 18, use it with a parent's or guardian's permission.

The app creates an account for your phone automatically. You can sign in with Google to keep your cards and Premium when you change phones, and Google sign-in is required to join the beta. Signing in with Google is also subject to Google's terms. We receive your Google account ID, email address and name, never your password.

Keep your Google account and your phone secure: you are responsible for what happens under your account. Pick a username that isn't offensive and doesn't pretend to be someone else. Don't share your account to get around limits.

Acceptable use

Use AxieFlash lawfully and fairly. Don't:

  • Get around access controls, such as beta access, Premium or the deletion lock.
  • Cheat the card economy, for example by changing the app or sending false results.
  • Look for or exploit security weaknesses. If you find one, tell us at axieflashdeveloper@gmail.com instead.
  • Abuse Cloud AI or other resources, for example with automated or excessive requests.
  • Attack, overload or disrupt our servers or other players.
  • Reverse engineer the service to get around its rules.
  • Put in unlawful or harmful material, or material that infringes someone else's rights, such as copyright.

Your content

Your notes, photos and files stay yours, and so do the cards made from them. We don't claim ownership of them.

Most of your content never leaves your phone. When you use Cloud AI, you give us permission to send the text of your notes to our AI provider and process it only to make the cards you ask for. We don't keep that text.

You must have the right to use anything you put into AxieFlash. You are responsible for the content you add.

AI-written cards

Cards made by Cloud AI come from an AI service and may be wrong, incomplete or misleading, including wrong answers or unclear questions. The server checks cards automatically, but we can't guarantee they are correct. Check important facts against your own sources before you rely on them, for example before an exam.

AxieFlash is a study aid. It doesn't promise any grades or results.

Free, beta and Premium

  • Cards are the in-game credit used to play. Everyone has a balance, with a daily refill and a cap of 600. Cards have no cash value and can't be transferred or exchanged for money.
  • The free plan has the limits shown in the app, such as the card balance and refill.
  • The beta is a free, time-limited test: 7 days of Premium-level access and a separate 200-card allowance, from the moment you redeem your code. It is not a subscription and nothing is paid. Beta features may change or be withdrawn, and the team can pause or end a tester's access. You don't keep beta access or beta cards after the beta ends.
  • Premium is planned as a monthly subscription through Google Play, currently shown in the app as ₱89.90 a month, that unlocks Cloud AI, Axie Run and a bigger daily refill. It is not available to buy yet, and neither are card top-ups.
  • Future purchases will be governed by the terms in force when they are introduced, which will be published here first, and by Google Play's terms. See the Refund Policy.

We may change how cards are earned and spent, and Axie Run's entry cost and prizes, with notice in the app.

Service availability

We aim to keep AxieFlash available, but it may be interrupted for maintenance, updates, technical problems or reasons outside our control, and features may be added, changed or removed. Cloud AI, sign-in, beta access and syncing need an internet connection; the rest of the app works offline.

Suspension and termination

We may restrict, suspend or end an account that breaks these terms, harms the service or other players, or is used for fraud or abuse, or where the law requires it. Where it's reasonable and safe to, we will tell you why. You can stop using AxieFlash at any time and delete your account in the app.

Deleting your account

In the app: Profile, Settings, Delete account. You are signed out straight away, the account is locked, and our server deletes it 24 hours later. In the current release, a deletion can't be cancelled. See Data Retention & Account Deletion for what is deleted and what is kept.

Intellectual property

AxieFlash, the Axie mascot, the artwork, music, sounds, built-in questions and software belong to axieflash or its licensors. You may use the app for your own personal study. Don't copy, resell or redistribute it. Third-party software and fonts are used under their own licences, listed in the app under Settings, Legal & Privacy, Licenses & Attributions.

Your own content stays yours (see Your content).

Disclaimers and liability

AxieFlash is provided as is and as available. We don't promise it will be error-free or uninterrupted, or that cards will be accurate.

To the extent the law allows, axieflash is not liable for indirect or consequential losses, or for results of relying on study material, including AI-written cards.

Nothing in these terms limits rights you have by law that can't be limited or waived. [LEGAL REVIEW REQUIRED]

Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines. [JURISDICTION AND DISPUTE RULES: TO BE CONFIRMED BY THE OWNER]

Changes and contact

If we change these terms in a way that matters, we will update the version and date here and ask you to agree again in the app.
